Hosting Services Terms & Conditions

WIRUlink Pty Ltd (hereinafter known as “WIRUlink”)
The Customer (hereinafter known as the “Customer”)

  1. Introduction

    The Hosting Service is a standalone product offered by WIRUlink, but can also be combined with connectivity or other WIRUlink products and/or services. These Terms & Conditions apply to all WIRUlink hosting packages, including Bronze, Silver, and Gold, as well as any custom hosting solutions. By using the Hosting Service, the Customer agrees to these Terms & Conditions as well as WIRUlink’s Standard Terms and Conditions.

  2. Hosting Service Description

    WIRUlink will provide the Customer with access to hosting management platforms, network infrastructure, and hosting resources as specified in the specific package description and/or features. The service may include POP3 email boxes, web hosting, domains, limited/unlimited data transfer, limited/unlimited storage space, limited/unlimited bandwidth, SQL or other databases or other features.

  3. Customer Responsibilities

    1. Data Backups: The Customer is solely responsible for maintaining up-to-date backups of all hosted data.
    2. Passwords & Access Security: The Customer must use secure passwords and change them, or request for these to be changed if managed by WIRUlink, regularly.
    3. Software & Code Compatibility: The Customer must ensure all software and code are compatible with the hosting environment.
    4. Acceptable Use: The Service may only be used for permitted purposes. WIRUlink may suspend the Service if misused.

  4. Definitions of Defective or Service Failure

    A defect refers to a material failure of WIRUlink’s hosting infrastructure. Failures caused by Customer software, external attacks, or force majeure events are excluded.

  5. Exclusions & Limitations

    1. WIRUlink can not be held liable for any reason whatsoever, including in the case of data loss, configuration errors, third-party software vulnerabilities, security breaches, viruses, malware, ransomware, hackers, etc..
    2. WIRUlink’s liability is limited to 1 (one) month’s hosting service fee.

  6. Security & Liability

    WIRUlink will take reasonable steps to secure the hosting environment but cannot be held liable for loss or damage except in cases of proven gross negligence.

  7. Data Protection & Disclosure

    WIRUlink will process Customer information in accordance with South African law and may disclose information when required to do so by law.

  8. Domain Names

    1. If specified in the specific package description or features, a .co.za or another specified TLD-domain and DNS hosting is provided for the duration of the subscription.
    2. On termination of the service, the final year’s domain fee will be billed to the Customer, at WIRUlink’s then standard rates, before any domain cancellation or Transfer request will be executed.

  9. SSL Certificates

    1. If specified in the specific package description or features, a SSL certificate, digitally signed by a reputable SSL authority, is provided for the duration of the subscription.
    2. On termination of the service, the final year’s SSL fee will be billed to the Customer, at WIRUlink’s then standard rates, before any cancellation request will be executed.

  10. Service Levels & Maintenance

    1. WIRUlink will endeavour to provide stable hosting services.
    2. Scheduled and unscheduled emergency maintenance may occur with or without prior notice.
    3. Remote technical support are available to Hosting customers, during WIRUlink’s standard support hours, as defined in “Fault Reporting & Escalation Procedure”, available on the WIRUlink website.

  11. Additional Clauses

    1. Intellectual Property: Customer retains ownership of hosted content.
    2. Indemnity: Customer indemnifies WIRUlink against claims arising from misuse.
    3. Prohibited Content: Illegal or harmful content may not be hosted.
    4. Support Scope: WIRUlink supports its own hosting infrastructure only and therefore can not provide customer support or assistance with other problems, including but not limited to web development, email client configuration, anti virus software, desktop support, etc..
