Black Friday 2020 - Terms & Conditions

Please read these Promotion Terms and Conditions (“Terms and Conditions”) carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate in this Promotion.

All participants during the term of this Promotion agree to be bound by the following Terms and Conditions which must be read together with the standard WIRUlink Terms and Conditions, the Debit Order Instruction, the Rental Application (if applicable), WIRUlink’s Quotation(s), WIRUlink’s Warranty and WIRUlink’s Acceptable Use and Fair Usage Policy and all other Legal Policies published on the WIRUlink website (hereinafter referred to as “the Service Contract’).

  1. The Promotions:
    1. Promotion A is named BLACK FRIDAY 2020 (“Promotion A”).
    2. Promotion B is named BLACK FRIDAY 2020 #ShareGoodInternet (“Promotion B”).
    3. Promotion C is named Budget 15Mbps and Budget 35Mbps wireless #NeedThe Speed packages (“Promotion C”).
    4. The promoter of Promotions A, B and C is WIRUlink (Proprietary) Limited, Registration number: 2006/011482/07 and/or its agencies ("the Organiser").
  2. The Promotion Period (“Promotion Periods”):
    1. Promotion A and Promotion B will run for four days only, from Friday, 27 November 2020 at 08h00 until (and including) Monday, 30 November 2020 at 17h00 (“Promotion A Period” and “Promotion B Period”).
    2. Promotion C will run from Friday, 27 November 2020 at 08h00 and continue indefinitely until ended with immediate effect at the sole discretion of the Organiser (“Promotion C Period”).
    3. Any changes to the Promotion Periods are at the sole discretion of the Organiser and may be extended or curtailed with or without notice. Any changes with notice, will be published on the Organiser’s website.
  3. Who may enter:
    1. All participants must: (i) be citizens of the Republic of South Africa and/or a legal resident of the aforesaid country, (ii) be currently residing in the Republic of South Africa at the date of the commencement of the Promotion Period, (iii) be a natural person or an authorised persons acting on behalf of a legal entity and be at least 18 (eighteen) years old.
    2. The Promotions are not limited to one promotion per household. Should there be any dispute in this regard, the Organiser shall be the sole adjudicator of the dispute and the Organiser’s decision shall be final.
  4. Promotion A - Reduced MtM installation fee
    1. Promotion A will afford the participant to select any Budget/Express/Professional 15Mbps or faster wireless package on a Month to Month agreement term and only pay a reduced once-off installation fee of R499.00 (including VAT).
    2. The reduced once-off Installation (labour) fee of R499.00 including VAT is payable on order, before on-site installation
    3. The reduced once-off installation fee is only for the labour of the installation and does not include any equipment, including but not limited to the outdoor wireless radio, indoor router, cabling, brackets and connectors.
      1. The basic hardware will remain the property of WIRUlink and a monthly rental fee will be charged. The monthly hardware rental fee is R219 incl. VAT per month or as stated during the order process.
      2. An indoor router is required to make use of the service. If opting to buy a router from WIRUlink during the order process, this will be billed as an additional once-off fee as stated during the order process.
    4. To qualify for Promotion A: The participant must (i) Place the order online (ii) Enter into a Service Agreement for any Budget/Express/Professional 15Mbps or faster wireless package, (iii) Enter into the Service Agreement during the Promotion A Period and (iv) submit all requested supporting documents within 10 days from order.
    5. Order Acceptance is at WIRUlink’s own discretion and may be based on internal affordability assessment.
  5. Promotion B - #ShareGoodInternet
    1. If an existing WIRUlink customer on a WIRUlink Budget/Express/Professional wireless package or EVOtel/SADV/VUMA Home Fibre package shares any one of the predetermined Black Friday posts on Facebook or Twitter social media platforms between 27 November 2020 and 30 November 2020, their current internet package will be upgraded to the next faster speed for 2 (two) months, for free.
    2. To qualify for Promotion B: The participant must (i) be an existing WIRUlink customer (ii) be on a WIRUlink Budget/Express/Professional wireless package or EVOtel/SADV/VUMA Home Fibre package, (iii) publicly share one of the WIRUlink predetermined posts on Facebook or Twitter from the #ShareGoodInternet Landing Page and (iv) do this during the Promotion B Period.
    3. The following additional criteria are applicable which may prevent and exclude a participant from receiving the 2 (two) months free speed upgrade:
      1. The participant is not on a WIRUlink Budget/Express/Professional wireless package or a EVOtel/SADV/VUMA Home Fibre package with WIRUlink;
      2. The existing equipment at the participant does not support the speed upgrade. No equipment upgrades will be done to enable the faster package speeds and will only be implemented remotely;
      3. The participant is already on the fastest package speed offered by WIRUlink;
      4. The participant only became a customer and/or signed up for the qualifying service on or after 1 November 2020;
      5. The current service link quality, line of sight or signal strength does not allow for the participant to achieve the upgraded package speed; or
      6. If upgrading the participant’s package will have a severe negative impact on the quality of service to other WIRUlink customers, determined at WIRUlink's sole discretion.
    4. The participants getting the free speed upgrade, will automatically be downgraded to their standard package speed after the 2 (two) calendar months.
    5. All qualifying participants, including participants excluded in clause 5.3 above, are automatically entered into a lucky draw to stand a chance to win their share of R14 000 (Fourteen Thousand Rands) in Takealot vouchers (“Vouchers”).
      1. The total Voucher value during the Promotion B Period, will be divided into multiple smaller Vouchers.
      2. Participants will only be entered into the lucky draws when sharing the WIRUlink Black Friday deals via the unique Black Friday #ShareGoodInternet landing page during the Power Hours held daily from 09h00 until 12h00 (“Power Hour time frame”).
      3. One or more lucky draws will be done daily, with each winner getting a single Voucher.
      4. A participant can only win a single Voucher per lucky draw, meaning that they will be able to enter again to win after each lucky draw during the Promotion B Period to win more Vouchers.
      5. Winners of the Vouchers will be notified via email, SMS, social media and/or a phone call during the Promotion B Period or by no later than 1 December 2020.
      6. Prizes are subject to availability. In the event of unforeseen circumstances, the Organiser reserves the right (i) to substitute alternative prizes of equivalent or greater value and (ii) in exceptional circumstances to amend or foreclose the promotion without notice. No correspondence will be entered into.
      7. The prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.
    6. Each customer only qualify for the speed upgrade on 1 (one) line/connection with WIRUlink. Should the same customer be linked to multiple lines/connections with WIRUlink, only 1 (one) of the lines will be upgraded. These customers will be contacted by WIRUlink to find out which line/connection the Participant wants to upgrade. Unique customers are identified by any combination of the following details: name and surname, company name, WIRUlink account number, contact telephone or mobile number(s), email address(es), browser cookies and data, unique landing page URL and/or installation address.
  6. Promotion C - New Budget wireless packages
    1. Two new fixed wireless packages have been launched namely the “Budget 15Mbps” and “Budget 35Mbps”.
    2. The maximum speed a customer can achieve on the
      1. “Budget 15Mbps” package
        1. for the first 200Gb (two hundred gigabytes) during the calendar month: 15Mbps download and 1.5Mbps upload;
        2. after the first 200Gb (two hundred gigabytes) during the calendar month: 5Mbps download and 0.5Mbps upload.
      2. “Budget 35Mbps” package
        1. for the first 200Gb (two hundred gigabytes) during the calendar month: 35Mbps download and 3.5Mbps upload;
        2. after the first 200Gb (two hundred gigabytes) during the calendar month: 5Mbps download and 0.5Mbps upload.
      3. Maximum speeds are not guaranteed and may be lower depending on customer signal quality and the time of day because of network, tower or sector congestion.
  7. Limitation of Liability

    To the extent permitted by Consumer Protection Act and any other applicable law the participant hereby indemnifies the Organiser against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants entrance to the Promotion and the Organiser excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).

  8. General:
    1. Any complimentary service fee, voucher or prize is not transferable. No substitution, cash redemption, or assignment of the equipment and/or the complimentary prize is permitted.
    2. WIRUlink’s Standard Terms and Conditions apply and can be viewed on the WIRUlink website at www.wiru.co.za.
    3. In accordance with the confidentiality policies and practices of the Organiser, none of the entry details of any participant in this Promotion will be disclosed to any third party but may be used by the Organiser to promote its other services. You are entitled to opt out should you no longer wish to receive such promotions. Please read our Privacy policy on the website.
    4. Information regarding the Promotion that is published on authorized advertising material will also form part of the Terms and Conditions of the Promotion.
    5. The Organiser’s may in their sole discretion amend these Terms and Conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised Terms and Conditions on the Organiser’s website https://www.wiru.co.za. The onus rests on the participant to constantly check the website for updates to the Terms and Conditions.
    6. The Organisers reserve the right, at any time, to verify the validity of participants (including a participant’s identity, age and place of residence) and to reject any participant who has not agreed to these Terms and Conditions. Errors and omissions may be accepted at the Organiser's discretion. Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights.
    7. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organiser, including but not limited to technical difficulties, unauthorized intervention or fraud, the Organiser reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion as appropriate, subject to the approval of relevant regulatory authorities.
    8. Save as permitted by Law, the Organiser reserves the right to cancel, suspend or terminate this Promotion, without notice at any time, and such cancellation, termination or termination shall be deemed to have taken effect from the date of publication on the Organiser’s website https://www.wiru.co.za. No liability shall lie against the Organiser in favour of any participant, winner(s) and/ or third party arising from such cancellation, suspension or termination. Therefore the participant waives his/her right which they may have against the Organiser and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organiser.
    9. This Promotion is governed by these Terms and Conditions and the Terms and Conditions of all related services and conditions as per the WIRUlink website.
    10. Any dispute or claim arising out of or in connection with the Promotion shall be governed by and construed in accordance with the laws of South Africa.
    11. To the extent that these Terms and Conditions conflict with the Terms and Conditions of WIRUlink service application, the Terms and Conditions of the latter will take precedence.
    12. The Organiser accepts no liability or responsibility, whether occasioned by any circumstances not foreseeable and not within its reasonable control for late or delayed delivery of the equipment and/or installation, but not limited to, stock unavailability, strike, lock out, destruction of the equipment on route by any means, any civil commotion or disorder, riot, threat of war, any action taken by governmental authority or public authority of any kind, fire, explosion, storm, flood, earthquake or other acts of God.
    13. If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
    14. All prices stipulated herein are including VAT.
